Acceptance

By accessing or using this website, you agree to these Terms of Use. If you do not agree, please do not use the website. These terms apply only to this website; a separate written agreement may apply if you later receive a service from Embark Well or an independent practitioner.

Information, not care

This website provides general information about Embark Well and its service pathways. It does not provide psychotherapy, diagnosis, medical advice, legal advice, regulatory advice, supervision, consultation, or emergency support. Website use and routine inquiries do not create a professional or service relationship.

Embark Well is not an emergency or crisis service. If there is immediate danger or urgent need, call 911 or contact an appropriate local crisis service.

Permitted use

You may use this website for lawful, personal, informational, and routine business inquiry purposes. You are responsible for the accuracy and lawfulness of information you submit and for ensuring that you have authority to provide it. Do not submit another person's personal information without an appropriate basis or authorization.

Cybersecurity and prohibited conduct

You must not use this website to:

  • gain or attempt to gain unauthorized access to any account, system, service, or data;
  • bypass security controls, probe for vulnerabilities, or test systems without written authorization;
  • introduce malware, harmful code, automated attacks, or disruptive traffic;
  • alter, delete, intercept, copy, or interfere with data without authorization;
  • impersonate another person, misrepresent your authority, or submit false or misleading information;
  • harass, threaten, defame, exploit, or violate the privacy or rights of another person; or
  • use website content or infrastructure in a way that is unlawful or materially disrupts the site.

Unauthorized computer access and interference with computer data may be offences under sections 342.1 and 430 of Canada's Criminal Code. Embark Well may restrict access, preserve relevant records, and report suspected unlawful activity where appropriate.

Intellectual property

Unless otherwise stated, the website's text, graphics, branding, videos, downloads, and other original materials are owned by or licensed to Embark Well and are protected by Canadian and other applicable intellectual property laws. You may view and print reasonable portions for personal, non-commercial use. You may not reproduce, adapt, publish, sell, remove attribution from, or commercially exploit website content without permission, except where applicable law allows it.

Communications and privacy

Information submitted through the website is handled according to our Privacy Notice. Routine website and email channels are not appropriate for clinical records, detailed personal health information, or urgent safety concerns.

If Embark Well sends a commercial electronic message, it will use consent or another basis permitted by Canada's Anti-Spam Legislation, identify the sender, and provide an unsubscribe mechanism where required. A routine inquiry does not, by itself, mean that you have agreed to receive unrelated marketing messages.

Availability and liability

Embark Well may update, suspend, or discontinue website content or functionality. The site is provided on an "as available" basis. Although reasonable steps are taken to support security and reliability, uninterrupted access, error-free operation, and complete security cannot be guaranteed.

To the fullest extent permitted by applicable law, Embark Well is not responsible for loss arising solely from reliance on general website information, inability to access the site, third-party links, or unauthorized acts beyond Embark Well's reasonable control. Nothing in these terms excludes rights or liability that cannot lawfully be excluded.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. Any dispute relating to the website is subject to the courts with jurisdiction in Ontario, unless applicable law requires otherwise. If one provision is unenforceable, the remaining provisions continue to apply.
